Usage Rules

Terms of Service

These terms of service (hereinafter referred to as “Terms of Service”) stipulate the terms and conditions for using the Health Self-Management Application—Nokosuken website designed for the service website browser (hereinafter referred to as “Website”), and the Health Self-Management Application—Nokosuken for smartphones (hereinafter referred to as “Application”), both provided by the Fukuoka Occupational Health Support Center (hereinafter referred to as “Fukuoka OHSC”). The services provided on the Website and Application are collectively referred to as “Services.” All registered users (hereinafter referred to as “Users”) shall use any of the Services in compliance with these Terms of Service.

 

Article 1 (Purposes)

These Terms of Service shall apply to all of Users of the Services, no matter whether the User is subject to the monitoring survey implemented by the Fukuoka OHSC.

 

Article 2 (Consent to Terms of Service)

  1. Users shall use any of the Services only after consenting to the Terms of Service.

 

  1. If the Services are covered by individual terms of service (guidelines, policies and the like to be stipulated separately from the Terms of Service), Users shall use any of the Services in compliance with all such individual terms of service in addition to the Terms of Service.

 

  1. Users who are minors shall only use the Services after obtaining consent thereto, including consent to the Terms of Service, of the person with parental authority or another legal representative. If a User who was a minor when the consent to the Terms of Service was once given uses any of the Services again after reaching adulthood, it shall be deemed that the User has retroactively confirmed the act of using the Services when the person was a minor.

 

  1. The User who has actually used the Website and/or the Application shall be deemed to have given their valid and irrevocable consent to the Terms of Service.

 

Article 3 (Account)

  1. Some of the Services require the registration of the User’s information. The User shall ensure that their latest and accurate information is registered.

 

  1. When registering a password for using the Services, the User shall strictly manage it under the User’s own responsibility so that all unauthorized use can be avoided. The Fukuoka OHSC may deem any act conducted with the User’s password as such User’s proper acts.

 

  1. Any User registered for the Services may withdraw from the Services after deleting their account by following the procedures set forth by the Fukuoka OHSC.

 

  1. The Fukuoka OHSC may delete the User account after one year or longer has passed since the last access without notifying the User concerned in advance.
  2. Any and all usage rights of the User for the Services shall terminate at the time of deletion of their account for any and all reasons. It should be noted that even if the User has erroneously deleted their account, it cannot be restored.

 

  1. The account of the Services shall belong only to the applicable User in person. No Users’ right or obligation in relation to the Services or Terms of Service shall be assigned or lent to, or inherited by, any third party.

 

Article 4 (Conditions for and restrictions of Services provision)

  1. In order for the User to use the Services, an internet communication environment is required. The communication-related fees shall be borne by the User. The User shall prepare a PC or smartphone with the relevant operating system, communication equipment, electric power, etc. under the User’s own responsibility and at their cost. If the User is a minor, only those for which the User has obtained permission from the person with parental authority or another legal representative shall be used.

 

  1. The Fukuoka OHSC may limit the provision of all or part of the Services to those Users who have fulfilled the requirements of the age and identification confirmation, information for registration and any other matters required by the Fukuoka OHSC.

 

  1. When deemed necessary, the Fukuoka OHSC may alter any of the Service contents or suspend/terminate the Services provision without prior notification to the User concerned without bearing any responsibility for any damage to be sustained by the Users.

 

Article 5 (Copyright)

All rights to any part of the Services, including the editor’s copyright, shall belong either to the Fukuoka OHSC or the third parties who own such rights. It is prohibited for the User to reprint, reproduce, store or transfer any part of the information provided by the Fukuoka OHSC without permission from it.

 

Article 6 (Information to Users)

  1. The Fukuoka OHSC will provide any information to Users concerning the Services by either posting the information in an appropriate section of the Services or in the Fukuoka OHSC-operated websites (including, but not limited to, the Website) or taking other measures considered to be appropriate.

 

  1. For the User to provide the Fukuoka OHSC with any messages concerning the Services, it is requested that the User either use the inquiry form available in an appropriate section of the Services or on the Service website or any other Fukuoka OHSC-operated website, or take other measures designated by the Fukuoka OHSC.

 

Article 7 (Protection of privacy and personal information)

  1. For the protection policy of the entire Fukuoka OHSC in collecting personal information and its universal handling standards, reference shall be made to the following document, which constitutes part of these Terms of Use, while the Terms of Service shall prevail in the event of a discrepancy or conflict due to the following document:

  1. The Fukuoka OHSC will obtain personal and other information (hereinafter referred to as “Information”) listed in the Attachment: Handling of Personal Information for the purposes stated in the Attachment as well as for the Services function evaluation and improvement, marketing analysis and other Fukuoka OHSC business objectives. The information obtained may be used in an individually unidentifiable form for Fukuoka OHSC product development, Services function evaluation and improvement, marketing analysis and other Fukuoka OHSC business objectives as well as presentations at academic conferences and submission of research papers.

 

  1. The management of personal information to be handled for the Services shall be made in accordance with the stipulation (4) Individual Information Management of the Attachment: Handling of Personal Information.

 

Article 8 (Utilization scope)

Users may use any information available in the Services for their private use alone and may not use it for any purpose of the User’s profit- or non-profit business or businesses.

 

Article 9 (Characteristics of information to be provided)

The Services are designed for the registration and browsing of the User’s physical condition and health information, including health checkup results. The information to be registered include actions conducted by the User themself and related third parties, including family doctors and family members, and the registration or these actions require the User’s consent. The Services do not fulfill the objectives of medical treatment or doctor’s business practices. Each User shall fully recognize this and utilize the Services under their own responsibility. If the User deems necessary, they are encouraged to take proper action such as visiting an appropriate medical institution, etc. no matter what is indicated in the Services-provided information. It is also recommended to give the Services-provided information to the doctors concerned, in which the User concerned has the right to select the information contents to be given. Every User is encouraged to perform daily health improvement activities by fully utilizing the Services under the instruction of the User’s home doctor and health nurse.

 

Article 10 (Submitted information contents)

  1. The contents of the information submitted by the User to the Services (hereinafter referred to as “Submitted Contents”) shall be backed-up by the User under their responsibility. The Fukuoka OHSC shall not be obliged to back up the Submitted Contents or provide any back-up measures.

 

  1. When it is necessary to confirm the compliance with the law and/or these Terms of Service, the Fukuoka OHSC may check the details of the Submitted Contents. However, the Fukuoka OHSC does not bear the responsibility for such checking.

 

  1. In the event that the Fukuoka OHSC recognizes that the Submitted Contents of a User violate or are likely to breach any law or these Terms of Service, it may freeze the use of the Submitted Contents for the Services, including deleting the Submitted Contents, without notifying the User concerned.

 

  1. Users shall submit contents to the Services only after confirming the protection thereof by the applicable law. Sharing a visual image in which a third party is included with others shall be done only under the User’s own responsibility. The Fukuoka OHSC shall bear no responsibility for infringing the Submitted Contents of any third party’s portrait rights, copyrights or any other rights.

 

Article 11 (Responsibility of application users)

  1. No certainty, usefulness or perfection is guaranteed with the information in these Services. All Users shall use the information available at the Services only at each User’s own discretion and under each User’s own responsibility. The user shall bear all responsibility for any acts taken based on information obtained from the Services and the results thereof.

 

  1. Even if these Services do not work as contemplated by the Fukuoka OHSC due to the specifications of the User’s website browser or smartphone and/or their compatibility with these Services, the User shall use the Services at their own discretion and under their responsibility.

 

  1. In the event that the Fukuoka OHSC confirms that a User is using these Services in breach of these Terms of Service, it will take appropriate and necessary measures at its own discretion. However, the Fukuoka OHSC does not bear any responsibility for preventing or rectifying such breaches.

 

  1. In the event that the Fukuoka OHSC incurs any damage, including the bearing of attorney’s fees, arising from a User’s use of the Services, which may include cases in which the OHSC receives complaints from third parties affected due to the User’s use, the User concerned shall compensate the Fukuoka OHSC for such damages forthwith, following the OHSC’s demands.

 

Article 12 (Disclaimer)

  1. The Fukuoka OHSC does not provide any explicit or implicit assurance concerning any and all de facto or legal defects, including those concerning safety, reliability, indemnity, effectiveness, adaptability to specific purposes and security. The OHSC is not responsible for providing Users with the Services after eliminating any of the aforementioned defects.

 

  1. The Fukuoka OHSC shall not bear responsibility for compensating for any indirect, special or extended damage inflicted on any User or third party as a result of the use of the Services, unless there is intent or gross negligence on the part of the Fukuoka OHSC.

 

  1. In the event that, in the use of the Services, a User incurs damage due to circumstances for which the Fukuoka OHSC is responsible, it shall compensate for the User involved up to the maximum limit being the amount of the communication charge, which is a maximum of 100 yen, unless there is intent or gross negligence on the part of the Fukuoka OHSC.

 

Article 13 (Force majeure)

Part or all of the Services may be interrupted or discontinued because of problems in the communication facility or system, need for regular or emergency maintenance, natural disaster, incident, war or any other force majeure event. It is also possible that part or all of the Services cannot be used depending on the terminal of the User. In any of these cases, the Fukuoka OHSC shall bear no responsibility to any User.

 

Article 14 (Governing law and jurisdiction)

In the event that any doubt or dispute arises with any User in the use of the Services, the Fukuoka OHSC will sincerely discuss the doubts or disputes with the User concerned. If any issue still remains unsolved, the matter shall exclusively be brought to the Fukuoka District Court or Fukuoka Summary Court, as courts of jurisdiction. These Terms of Service shall be governed by, and construed in accordance with, the laws of Japan.

 

Article 15 (Prohibitions)

In the event that the Fukuoka OHSC confirms that a User has committed any of the following acts (hereinafter referred to as “Prohibited Acts”), it may suspend/terminate further use of the Services and/or the account of the User without notification. If the Fukuoka OHSC sustains damage as a result of the User’s committing a Prohibited Act or in any other case in which the Fukuoka OHSC deems it appropriate, the Fukuoka OHSC may seek damages from the User concerned and/or notify the relevant public agency accordingly.

 

(1) An act of violation, or potential violation, of any of the Terms of Service or any law

(2) An act of damaging the intellectual property right, such as copyright, trademark right or patent right, or any proprietary right or personal right, such as right to reputation, as well as the privacy right of either the Fukuoka OHSC or any third party from whom the Fukuoka OHSC is granted license thereof.

(3) An act of disposing of, or letting others use, the use right to the Services or any data related to the Services, by lending, exchanging, transferring, selling, pledging, collateralizing or any other means other than the means set forth by the Fukuoka OHSC.

(4) Business operation, advertising, soliciting or any other profit-making act, unless the Fukuoka OHSC gives in-advance authorization; religious activity or an act of invitation to a religious organization; an act of dating or association with an unacquainted person of the opposite sex; displaying, or making others display, information concerning child pornography or child abuse; an act for the purpose of harassing, defaming or bullying a third party; or any other act for any purposes other than those contemplated in the Services.

(5) An act of impersonating the Fukuoka OHSC or any third party; purposefully distributing false information; willfully collecting, disclosing or providing a third party’s personal information; and/or inflicting, or being likely to inflict, disadvantage or damage to the Fukuoka OHSC, other members or any third parties.

(6) An act of submitting or sending excessively violent expression; sexually explicit representation; depiction potentially resulting in discrimination based on ethnicity, nationality, ideology, gender, social status or family origin; description inducing or encouraging suicide, self-injury or drug abuse; or any other unsocial representation that is unpleasant to others.

(7) Fraudulent access to the Fukuoka OHSC systems, spreading computer viruses, data falsification or any other act hampering the proper operation of these Services.

(8) An act resulting in, or likely to result in, a crime or an act of encouraging such.

(9) An act of providing incorrect or false answers in a questionnaire or survey.

(10) An act of encouraging or helping an act falling under any of the above.

(11) Any other act of the User of the Services that the Fukuoka OHSC considers inappropriate.

 

Article 16 (Handling of external links)

The Website may show links, guides, etc. to external websites or services operated by third parties, not the Fukuoka OHSC (hereinafter referred to as “External Links, etc.”). Each User shall utilize each External Link, etc. only under their sole responsibility, after taking care of each of the following points:

 

(1) In utilizing an External Link, etc. the use rules, etc. stipulated by the operator of such External Link, etc. shall be applied with priority.

(2) Contents or services to be provided in an External Link, etc. may require a charge. Such charge shall be borne by the User concerned.

(3) The Fukuoka OHSC provides no assurance of the contents or services offered by an External Link, etc. and bears no obligation to verify the certainty, usefulness or perfection of such.

(4) In the event of damage or a dispute arising from contents or services provided by an External Link, etc. it shall be resolved between the involved User and the operator of the External Link, etc. concerned, and the Fukuoka OHSC shall bear no responsibility therefor.

(5) Any inquiry concerning details of the contents or services provided by an External Link, etc. shall be directed to the operator of the External Link, etc. concerned.

 

Article 17 (Advertisements)

The Fukuoka OHSC may advertise in the Services at its sole discretion.

 

Article 18 (Geographical area of service provision)

The Services shall be provided for use only within Japan.

 

Article 19 (Alteration and abolishment of terms)

  1. The Fukuoka OHSC may revise, add, alter and/or abolish any of the regulations of the Services, Terms or Service or individual terms of service by notifying Users thereof in advance during a reasonable time period. After such period, the Users shall abide by the Terms of Service and individual terms of service with revisions, additions, alterations and abolishment reflected.

 

  1. The Terms of Service and individual terms of service subject to alteration, etc. shall be posted in an appropriate section of the Services or in the Fukuoka OHSC-operated websites (including, but not limited to, the Website), and will become effective after the lapse of a reasonable time period. The User who actually continues to use the Services after the alteration, etc. of the Terms of Service, or the individual terms of services, shall be deemed to have given their valid and irrevocable consent to the alterations, etc. thereof. Users are recommended to refer from time to time to the latest Terms of Service or individual terms of service when using the Services.

 

Article 20 (Privacy policy for Application)

This Application Privacy Policy concerns user information sent from the Services and its handling. Everyone is encouraged to use the Services after recognizing and agreeing to this Application Privacy Policy.

20.1 User information, purposes, recipients, etc. of information transmitted from the Services

Third party recipients:

The information sent to the Fukuoka OHSC is not provided to any third parties.

 

Means to suspend information transmission and its effects, etc.

The transmission of information cannot be suspended. Those Users who want to stop receiving information for any inevitable reason are encouraged to terminate the use of these Services.

20.2 Collection and handling of personal information

If personal information is included in the information to be collected for these Services and/or any other services related to the Services, Fukuoka OHSC shall collect such information only after receiving the explicit consent of the User concerned by clarifying the purposes of using, whether to provide the information to any third parties, and any other legally required matters in every situation of information collection (on the screen to input/send personal information, etc.).

 

* Personal information is information concerning an individual with which the individual can be identified based on their name, birthdate or any other description, including information that can easily be matched with other information and thereby identifying individuals.

20.4 Alteration of privacy policy of the Services

During the course of upgrading the Services, the items of User information, purposes of collection, or information recipient may be altered, in which case, the privacy policy of the Services will be revised. For such changes, reference is encouraged to the latest privacy policy of the Services indicated in the latest version of the Services. Users’ consent to the alteration may be required again depending on the alteration details.

*4    For marketing purposes, based on statistical analysis of Services use history:

Information required: All the information required will be made unidentifiable and used as statistical data.

 

(3) Provision of personal information to third parties

Personal and/or other information received from Users may be provided to the local governments of the areas where each User lives and/or the event organizer for the purposes of operation, evaluation and improvement of the local government services or marketing analysis.

In any cases that do not fall under the above conditions, personal or other information received from Users will not be provided to any third parties, unless provision is mandated by law, or required for the protection of human life, health or property.

 

(4) Response to disclosure request

Concerning the personal and/or other information owned by the Fukuoka OHSC, inquiries about notification of purposes of using, disclosure and/or corrections, requests for suspension/termination, and prohibition of provision to third parties are requested to be addressed to the Contact Center below, which will respond to each case within a reasonable period of time.

 

(5) Management of personal information

*1 The information handled by the Services will be managed properly in accordance with the Act on the Protection of Personal Information (Act No. 57 of May 30, 2003).

*2 The Fukuoka OHSC as well as each of the local governments, non-profit organizations (NPOs) and corporations with which the Fukuoka OHSC partners bear the responsibility for management of the information handled by each.

*3 The information concerning each User collected and owned in the Services shall be destroyed after the discontinuation of their usage and registration.

 

(6) Voluntary information provision

When the Fukuoka OHSC asks a User to provide their personal and/or other information, the provision shall be made on a voluntary basis by the User. If one of the mandatory input items is not provided, the User may not be able to receive proper Services.

Notes for inquiries

* Every inquiry is being responded to in the order received. However, some inquiries may take more time for response. User understanding will be appreciated.

* While inquiries are accepted at any time of the day, responses are sent from 9:00 a.m. to 5:30 p.m. on weekdays.

* Mail systems with spam prevention measures on may not accept replies from the Contact Center. It is requested to set the system to accept email from the domain: @fukuokas.johas.go.jp.

Personal Information Protection Policy

Personal information protection of personal information of JOHAS homepage users

JOHAS will properly handle the collection, use and management of personal information on the JOHAS homepage, and further endeavor to ensure worry-free use by every homepage user (hereinafter referred to as “JOHAS User”) by fully respecting the privacy of each one.

Information concerning each individual which can reveal the identification of the person with the clues of some descriptions in the information, such as the address, name, telephone number and email address.

 

*   Collection of personal information and its purpose

While JOHAS Users can access the homepage via the internet without presenting personal information in normal cases, in some cases, such as sending inquiries, personal information will be required. In such cases, purposes of information collection will be clarified and, only on receipt of the JOHAS User’s acceptance, the minimum necessary information will be collected.

The purposes of using personal information are clarified in each section in which the information is requested.

For JOHAS Users’ continued smooth use of the JOHAS homepage, it applies HTTP cookie technology to obtain JOHAS User access records. While this technology can distinguish the PC used to access the JOHAS homepage, personal JOHAS User information, such as addresses and names, is not included in the information subject to the cookies.

In such case, it is possible to ask such an outside party to respond after obtaining the consent of the JOHAS User concerned. Therefore, JOHAS will not be in a position to take responsibility for the personal information handling of such third parties. Concerning the handling by the information recipient, the JOHAS Users are requested to directly inquire of such organizations.
